If he committed acts of terrorism, yes torture the person, he/she dosn't fall under the Geneva convention or civilian law, but only after a trail with an international court that finds him/her guilty.

I'm not sure if this is specific to America, if so it's about whether our government has the authority to torture. The government gets their power from us, they can't do anything you or I can't do. They simply don't possess the power to infringe like that. The Constitution was meant to restrain the government, it does nothing specific for us.
