That just says that derivative art can't be sold, which it's not, and that it can be uploaded to social media sites, which I'm not doing. Can I assume that, because I'm not selling anything and neither is Digital Extremes, that this doesn't infringe on the copyright?

Haha! I've tried to contact them in the past and they don't ever respond.

Unfortunately they get hundreds of messages a day and they may not be able to respond to everyone, or may not have a answer to give. Legal issues are complex when it comes to trademarks.
