At what point is HYPE False Advertising (Not a BASH DESTINY THREAD)

So I have a question for the community and don’t get all worked up about this being a destiny bash thread because it’s not. Recently I read an article about how Sony is being sued over Kill zone because they talked about how the Muliplayer would be 1080p natively in all there pre game advertising and by Pre Game advertising I am talking about developer interviews, and trailers released. When the game came out the graphics where unscaled to 900x1080p and some people that purchased the game thought this was a form of false advertising because they were not sold what they were promised, they convinced a lawyer to file and so far a judge is agreeing, the Judge just having thrown out all but one of sony’s claims for rejecting the suet. The people involved have 30 days to amend. Anyway this is also not a thread about if we should be able to sue for this stuff, if a $60 game is worth going to the trouble for so let’s not go down that path. Aliens Colonel Marine (I think that’s the name) is also being sued for similar reasons, game was represented as one thing and ended up being different. So this got me thinking, with so many games building hype for their product before they even have a finalized product, making promises of features or by videos and interviews insinuating that specific features will be available at what point does this become false advertising? You are hyping a game that doesn’t exist and in the end key features or selling points are not found with in the game. So here is my question to the community. It’s got 3 parts to it. The first is simple, if a game developer or publishers releases multiple trailers and interviews leading up to the launch of a game and things they claim in the interviews or that are shown in the video’s end up not being part of the game, or if the game depicted/talked about end up being nothing like what they hyped should that game company be held responsible the same as any other company would be if they advertised their product to the masses as one thing and you got something else. I.E False advertising. OR does the fact that they put a little piece of text at the bottom of the trailers/interviews which says “Product still under development things may change” completely excuse them from any sort of wrong doing. And finally if you are in favour of the second option I have a follow up question for you. If the game was hyped as one thing, having a specific set of features and while in development shit happens and these features disappear should the company not be responsible to, in some way, communicate to the purchasing base that specific items that they talked about in Video’s and interviews that they wanted to achieve but couldn't would not be in the game, at least at launch and here is the actual accurate representation of what the finished game is with the actual features found. Or are they OK to allow the hype they built up with players expecting things to stand as is and have no obligations to correct the perception that they created?
